How Lawsuits Are Used To Resolve Civil Disputes

Lawsuits are the system used to resolve disputes in civil cases. When one individual or organization believes that they have a legitimate claim for compensation or relief from another, they can use the courts in the jurisdiction where they are based to try to make this happen. It is as well to realize right at the start that going to court always involves risk, no matter how strong your case may be. You still need to present that case to the judge, in such a way as to be able to convince people that it is justified.

It is impossible to give a definitive overview of how the system works, as it is different in every jurisdiction. There are some similarities which are often found, but virtually nothing which could be said to be universal other than the obvious necessary elements of a plaintiff, a defendant, and a presiding judge. The plaintiff will need to prepare a statement of case. This is usually, but not always, submitted to the court. The court will forward the case papers to the defendant, who will then be obliged to answer the statement.

Each jurisdiction has its own peculiarities in both law, and in the way that law is prosecuted. In theory, if a party fails to comply with the regulations which are laid down, they will risk losing their case and having it struck out. In practice, varying degrees of leniency are applied depending on circumstance. Complications can also occur if one or more of the parties issues either a supplementary claim, or a counterclaim to the original action. The majority of civil actions are settled out of court, with the parties coming to agreement to save potential heavy losses.

Finding a lawyer to help you cope with this process is essential if you want to give yourself the best chance of coming out on top, but you will need to find someone who is a specialist in the field of law you are dealing with. Not all lawyers have full knowledge of all areas of the law. Worryingly, even some judges do not know all aspects of the law they are adjudicating on, which means you simply must have enough knowledge to be able to put your case effectively, with precedents being demonstrated.

There are some lawsuits where the expense of bringing in a lawyer would be prohibitive. These are the small cases where the amount which is in dispute is small and relatively insignificant. These cases are always better settled out of a court room as the legal expenses are going to be completely out of proportion to the amounts involved, and all court cases involve some degree of risk. If you do end up having to go to court, you will need to present your own case. This is relatively easy to do in simple lawsuits.
