Why Mortgage Lawsuits Should Be Avoided Wherever Possible

Mortgage lawsuits are one of the inevitable features of the lending system which prevails in most Western countries. The vast majority of home owners would never be able to break into the market if they had to save up the entire price of a property before they bought one. Lending is necessary to allow the entire system to function, but it is inevitable that when two parties are involved in such a long term contract that there will be disputes sometimes. For the most part, the mortgage system works well in providing the service people need.

The mortgage loan is one of the building blocks of our capitalist society, yet there are hidden dangers built in. One of these is the possibility of a severe economic downturn, which can send property prices tumbling down, leaving home owners with a negative equity. This effectively takes away their ability to sell, and locks them in to having to take the worst that the depression can throw at them. Lenders do not want to repossess properties, and then be stuck with the job of selling them on in depressed markets, but there are obviously occasions when it is necessary.

In some cases, people whose properties are about to be repossessed will fight on to the very last. They will not move until they are physically forced out of the property and it is all completely over. The legal system then becomes the only way that the mortgage lender is actually going to be able to repossess the property. As there are no provisions in criminal law for dealing with mortgage non-payers, the lender has to seek relief through the civil courts.

Keeping your home in an economic downturn is never easy to do, especially if there is also a rise in interest rates to which the property is tied. If any members of your family have managed to stay in work, it may be possible to budget tightly through the crisis and still meet the mortgage payments. You could try to negotiate with the lender to make reduced payments to see you through a short term crisis. Another possibility is to reduce your own living space and let one of your rooms out to someone else. In many jurisdictions this will bring you a tax free income.

Even if you do end up embroiled in mortgage lawsuits, you can still try to negotiate an out of court settlement which will avoid further losses on lawyer fees. Money lenders are always realistic about the possibilities at this stage, as they know there are only limited amounts of money they can extract from people who are in desperate trouble. Cut your expenses by not engaging a lawyer, and always try to find an out of court solution to mortgage lawsuits.
